This essay by Hans Kelsen, included in his 1925 work Allgemeine Staatslehre and reproduced here in a previous Italian translation, analyzes the distinction between public and private law, challenging the traditional dichotomy between the two categories and highlighting the uncertainty surrounding the subject matter of this division. In the course of the argument, the author compares the two spheres, examining traditional conceptions of public and private law in relation to the concepts of the legal order and the rule of law.
