The Possibility for Same-Sex Couples and Single Individuals to Access Medically Assisted Reproduction: Towards What Concept of Family?

This paper aims at considering the evolution of medical assistance procedures dealing with same sex couples and singles. The present works takes into account the legislative reforms and the jurisprudential decisions taken by the Italian Constitutional Court and the European Court of Human Rights. Thanks to a comparative perspective and after social changes we could underline both the importance of Parliament’s action and of constitutional justices’ support. These comprehensive innovative tools are vital to define a new notion of family, in a modern and transformed legal system.
