The Constitution and Families: A Relationship in Constant “Transformation”

Abstract

After a careful analysis of the salient features of the debate that took place in the Constituent Assembly of Italy on the rules to be dedicated to the family, the paper focuses on the main interpretative, legislative, and above all (due to parliamentary inertia) jurisprudential developments that the Italian legal system has undergone in this area. These transformations seem to have accelerated considerably in recent times. The family issue is therefore proving to be a constantly evolving area, with further changes likely due to the extra-legal developments currently underway in the fields of technology and biology.
