This is a reproduction of Emilio Betti’s (1890–1968) study on the general principles of the new Fascist legal order, published in 1943 in the volume Studi sui principî generali dell’ordinamento giuridico fascista, edited by the Faculty of Law and the School of Advanced Studies in Corporate Disciplines of the Royal University of Pisa. In particular, the contribution addresses the problem of the legislative formulation of the general principles of the Fascist legal order, examining the legislator’s authority to identify them, the appropriateness of formulating them, and the content to be attributed to such principles.
